Driver App Terms of Use

These Terms of Use (the “Terms”) are an agreement between you and Stella International, Inc., doing business as Quarry Connect (“Quarry Connect”, “we” and “us”). They cover the Quarry Connect Driver App (the “Driver App”), this website, drivers.quarryconnect.com, and the text messages and message links we send to Drivers. By downloading or using the Driver App you agree to these Terms. If you do not agree, do not use it.

Privacy

Our Driver App Privacy Policy explains what the Driver App collects, including your location while a Job is in progress, and how it is used and shared. It is part of these Terms.

Who can use the Driver App

You must be at least 18 and hold the licenses your work requires. The Driver App is free for Drivers.

Quarry Connect and the Brokers you work for

Brokers use Quarry Connect Software (the “Software”) to run their business, and the Driver App connects you to them. Quarry Connect is not a Broker, carrier or employer and is not a party to any agreement between you and a Broker. Your Jobs, rates, pay, insurance and working terms are between you and the Broker. Quarry Connect does not guarantee any amount of work or payment.

Your account

Keep your sign-in details to yourself. You are responsible for everything done under your account. The information you enter, including times, tickets and photos, must be true and accurate, because Brokers use it to invoice their Customers and to pay you. We may suspend or close an account that is misused or that breaks these Terms.

Driving safely

Do not use the Driver App while your truck is moving. Pull over safely before reading messages, taking photos or entering information. Follow all traffic laws and your Broker’s safety rules. Route recording runs on its own and needs nothing from you while you drive.

Using the Driver App

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Driver App on phones you own or control, for your work with Brokers that use Quarry Connect. You may not copy, modify, reverse engineer, resell or rent the Driver App; interfere with its operation or security; access accounts or data that are not yours; or use it for anything unlawful.

Text messages (SMS)

Program. Quarry Connect Job texts, sent by Stella International, Inc. (Quarry Connect) on behalf of the Broker you drive for. Messages cover Job assignments, schedule changes, cancellations, status checks and replies from dispatch. No marketing messages are sent.

Consent. You agree to receive these texts when you sign up as a Quarry Connect Driver and confirm your mobile number, or when the Broker you work for adds you with your agreement. Consent is not a condition of any purchase.

Frequency and cost. Message frequency varies with your work. Message and data rates may apply.

Opting out and help. Reply STOP to stop receiving texts from that number; you will get one confirmation text. Reply START to resubscribe. Reply HELP for help, or contact sales@quarryconnect.com.

Carriers. Carriers are not liable for delayed or undelivered messages.

Our content and trademarks

The Driver App, the Software and their content are owned by Quarry Connect or its licensors and are protected by copyright and trademark law. “Quarry Connect” and “Quarry Connect Driver App” are trademarks of Quarry Connect and may not be used without our written permission.

Ending your use

You can stop using the Driver App at any time and ask us to delete your account. These Terms end when your account is closed. The sections on ownership, disclaimers, limitation of liability and disputes continue to apply.

Disclaimer of warranties

THE DRIVER APP IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULL EXTENT PERMITTED BY LAW, QUARRY CONNECT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE DRIVER APP WILL BE UNINTERRUPTED, ERROR FREE OR FREE OF VIRUSES, OR THAT ROUTES, TIMES OR MESSAGES WILL ALWAYS BE RECORDED OR DELIVERED.

Limitation of liability

TO THE FULL EXTENT PERMITTED BY LAW, QUARRY CONNECT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PAY, PROFITS OR WORK, ARISING FROM YOUR USE OF THE DRIVER APP. SOME STATES DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT ALL APPLY TO YOU.

Apple App Store terms

If you downloaded the Driver App from Apple’s App Store:

  • These Terms are between you and Quarry Connect only, not with Apple Inc. (“Apple”). Quarry Connect, not Apple, is solely responsible for the Driver App and its content.
  • Your license to use the Driver App is limited to Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the Driver App may be used by other accounts associated with you through Family Sharing or volume purchasing.
  • Quarry Connect is solely responsible for maintenance and support of the Driver App. Apple has no obligation to provide any maintenance or support for it.
  • If the Driver App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the Driver App. To the maximum extent permitted by law, Apple has no other warranty obligation for the Driver App. Any other claims, losses, liabilities, damages, costs or expenses from any failure to conform to a warranty are Quarry Connect’s responsibility.
  • Quarry Connect, not Apple, is responsible for addressing any claims by you or a third party about the Driver App or your possession or use of it, including product liability claims, any claim that the Driver App fails to conform to any applicable legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
  • If a third party claims that the Driver App or your possession and use of it infringes that third party’s intellectual property rights, Quarry Connect, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
  • You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • You must comply with any third-party terms that apply when using the Driver App, such as your wireless data service agreement.
  • Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

Governing law and disputes

The laws of the State of Texas, without regard to its conflict-of-law principles, govern these Terms and any dispute about the Driver App. Any dispute in which the total claim exceeds $7,500 shall be decided in the courts in Austin, Texas, and you consent to their exclusive jurisdiction and venue.

Changes

We may change these Terms from time to time. The version posted here is the one in effect, and the date at the bottom of this page shows when it last changed. If we make material changes, we will tell you in the Driver App or on this website. If any of these Terms is found unenforceable, the rest still apply.
